Terms of Service

These Terms of Service ("Terms") govern your access to and use of WhatsApp Ordering at ping2buy.com and related services (the "Service") operated by us ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms.

1. The Service

WhatsApp Ordering is a multi-tenant platform that enables restaurants and similar businesses ("Tenants") to connect WhatsApp Cloud API numbers, manage menus and orders, and communicate with customers through WhatsApp. Staff users access dashboards to operate the Service on behalf of a Tenant.

2. Eligibility and accounts

You must be authorized by a Tenant to use staff features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

3. Acceptable use

You agree not to:

Use the Service for unlawful, fraudulent, or abusive purposes
Interfere with or disrupt the Service or its infrastructure
Attempt to access data belonging to other Tenants
Reverse engineer or scrape the Service except as permitted by law
Send spam or messages that violate WhatsApp or Meta policies

4. WhatsApp and Meta

Use of WhatsApp messaging features is subject to Meta's WhatsApp Business Terms, Commerce Policy, and related policies. Tenants are responsible for obtaining valid WhatsApp Business accounts, complying with opt-in and messaging rules, and ensuring customer consent where required.

5. Tenant content and data

Tenants retain ownership of menus, branding, and customer interaction data they submit. You grant us a limited license to host, process, and transmit that content solely to provide and improve the Service.

6. Fees and availability

Pricing, if any, will be agreed separately with Tenants. We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when practicable.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT MESSAGES WILL ALWAYS BE DELIVERED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU (OR YOUR TENANT) TO US IN THE TWELVE MONTHS BEFORE THE CLAIM.

9. Indemnification

Tenants and authorized users agree to indemnify and hold us harmless from claims arising out of their use of the Service, their content, their WhatsApp messaging practices, or violation of these Terms or applicable law.

10. Termination

We may suspend or terminate access to the Service for violation of these Terms, legal requirements, or risk to the platform. Tenants may discontinue use at any time. Provisions that by nature should survive termination will remain in effect.

11. Changes

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws applicable in the United Arab Emirates, without regard to conflict-of-law principles, unless mandatory local law requires otherwise.
